Bid Description:
On June 8, 2021, Governor Phil Scott signed Act 74 (Bill H.439). Act 74 transferred $4.5 million to the Environmental Contingency Fund (ECF) for the completion of indoor air quality testing for polychlorinated biphenyls (PCBs) in public schools and approved and recognized independent schools that were constructed or renovated before 1980. Act 74 requires schools that meet these criteria to test for PCBs in indoor air on or before July 1, 2024. Act 74 also amended the definitions of a “release” in 10 V.S.A. § 1283(g)(3) and 10 V.S.A. § 6602(17) to include: “Release” also means the intentional or unintentional action or omission resulting in the spilling, leaking, emission, or disposal of polychlorinated biphenyls (PCBs) from building materials in a building or structure. With this amendment to the definition of a release, any detections greater than 15 ng/m3 is considered a release and therefore will need to comply with the Investigation and Remediation of Contaminated Properties Rule (IRule). The State of Vermont Agency of Natural Resources (ANR) Department of Environmental Conservation (DEC) is seeking a Request for Proposal (RFP) from Qualified Environmental Professionals (QEPs) to conduct indoor air sampling for PCBs in schools.
