Bid Description:
The Clean Water Service Delivery Act of 2019 (Act 76) changes the administration and implementation of clean water funds in the State of Vermont. A notable change resulting from the Act is the establishment of clean water service providers and the Water Quality Restoration Formula Grant Program, effective November 1, 2021.
Clean water service providers, for watersheds draining to Lake Champlain and Lake Memphremagog, must be established through rulemaking by November 1, 2020. Service providers will be responsible for identifying, prioritizing, developing, implementing, and operating and maintaining projects to meet interim phosphorus reduction targets. The service providers’ phosphorus reduction targets will be associated with non-regulatory activities under the Phosphorus Total Maximum Daily Loads (TMDLs) for Vermont Segments of Lake Champlain and the Lake Memphremagog Phosphorus TMDL to ensure voluntary measures (i.e., not driven by clean water regulations) will be met and TMDL targets will be achieved. Funds will be distributed to service providers through a formula based on its phosphorus reduction target and a standard cost per unit of phosphorus reduced. Additionally, a service provider will be responsible for the long-term operation and maintenance (O&M) of all non-regulatory clean water projects in its region.
