NOTICE OF INVITATION TO BID Removal of Asbestos-Containing Materials Waterbury State Office Complex Buildings 4, 5 and 6/7 North Porch Roofs 103 South Main Street - Waterbury, Vermont The State of Vermont – Department of Buildings & General Services hereby requests a written proposal for the proper removal and disposal of asbestos-containing materials located on the porch roofs of Buildings 4 North, 5 North and 6/7 North at the Waterbury State Office Complex in Waterbury, VT as set forth in the Asbestos Abatement Bid Documents and per the pre-bid site visit conducted on May 7, 2014. All work is to be performed in accordance with the asbestos abatement specifications along with State and Federal regulations for asbestos control. A non-mandatory pre-bid site visit is scheduled for Thursday July 10, 2014 at 10:00 AM. Bidders will meet at the Weeks Building. Bidders are encouraged to carefully examine the documents and site. All quantities of asbestos-containing materials provided in the documents are approximate. Bidder is responsible for verifying actual amounts of asbestos-containing materials prior to submitting their bid. No extra compensation will be awarded for failure to verify material quantities or site conditions. All pertinent questions that arise from the site visit will be answered in an addendum. Bidder’s Qualifications - Bidder must be licensed as a Vermont Asbestos Abatement Entity upon submission of bid. The license shall be valid for the duration of the project. The Entity shall have a minimum of three years asbestos abatement experience with projects of a similar nature and size of the project described herein. Submission Instructions – Proposals are due no later than Friday July 11, 2014 by noon. The bids may be delivered, faxed, or emailed as follows based on the closing date identified in the Bid Documents. All times stated shall be Eastern Time. Any proposal or modification received after the time and date stated on the Bid Documents shall be rejected. 1. Email: If email submission, responses to be submitted by email to SOV.ThePathForward@state.vt.us. Submit one response electronically by the due date provided in the Bid Documents. All responses must have a signature either by signature affixed thereto, either by manually signing the document, prior to scanning it and uploading it with your submission, or affixing it electronically. 2. Fax: If fax submission, responses to be submitted by fax to: 802/828-2222 If a FAX bid is submitted, Bidders are cautioned that it is their responsibility to originate the message in sufficient time to insure receipt by the Office of Purchasing & Contracting prior to the time of the bid opening. All pages must be printed and in the possession of the division prior to the date and time of the bid opening or the bid will not be considered. FAXED bidders are cautioned that bids submitted by the FAX method may be compromised prior to the time of the sealed bid opening. FAXED information is accessible when transmitted and confidentiality cannot be guaranteed. State reserves the right to reject a faxed bid if it appears that the faxed bid is incomplete or portions of the faxed bid or eligible. 3. Any and all notifications, releases and amendments associated with this project will be posted at http://www.blueprintsetc.com. There is a non-refundable fee of for each set of documents. Please be advised that all notifications, releases, and addendums associated with this RFP will be posted on-line in the plan room where the original solicitation resides unless otherwise determined that a hard copy is necessary. The state will make no attempt to contact contractors with updated information. It is the responsibility of each contractor to periodically check the posting site for any and all notifications, releases and addendums associated with the RFP. 2. NOTE: On occasion hard copy addendums may be required due to size or type of media/requirements. If applicable and as determined by the Department of Buildings and General Services, addendums that require hard copy distribution, a copy of such addenda will be mailed or delivered for each set of plans and specifications issued to the bidders, prior to the bid date. However, it is the responsibility of the bidder to be sure they have received all addenda, and must so state the number of addenda they have received on the proposal. Funding Source: This project is being funded, in whole or in part, through the state’s capital construction act(s) and shall require compliance with the Vermont Prevailing Wage Rate requirements (see Attachment D, paragraph17). FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA): This project is subject to and must comply with Federal Emergency Management Agency (FEMA) requirements under 44 CFR 13.36. Federal agencies are permitted to require changes, remedies, changed conditions, access and records retention, suspension of work, and other clauses approved by the Office of Federal Procurement Policy. As such, the bidder must comply with the following provisions and supplemental specifications of 44 CFR 13.36 (i) identified below as part of this RFP. • Administrative, contractual, or legal remedies in instances where contractors violate or breach contract terms, and provide for such sanctions and penalties as may be appropriate. • Termination for cause and for convenience by the grantee or subgrantee including the manner by which it will be effected and the basis for settlement. • Compliance with Executive Order 11246 of September 24, 1965, entitled “Equal Employment Opportunity” as amended by Executive Order 11375 of October 13, 1967, and as supplemented in Department of Labor regulations (41 CFR chapter 60). • Compliance with the Copeland Anti-Kickback Act (18 U.S.C. 874) as supplemented in Department of Labor regulations (29 CFR Part 3). • Compliance with Sections 103 and 107 of the Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by Department of Labor regulations (29 CFR Part 5). • Notice of awarding agency requirements and regulations pertaining to reporting. • Notice of awarding agency requirements and regulations pertaining to patent rights with respect to any discovery or invention which arises or is developed in the course of or under such contract. • Awarding agency requirements and regulations pertaining to copyrights and rights in data. • Access by the grantee, the subgrantee, the Federal grantor agency, the Comptroller General of the United States, or any of their duly authorized representatives to any books, documents, papers, and records of the contractor which are directly pertinent to that specific contract for the purpose of making audit, examination, excerpts, and transcriptions. • Retention of all required records for three years after grantees or subgrantees make final payments and all other pending matters are closed. • Compliance with all applicable standards, orders or requirements issued under section 306 of the Clean Air Act (42 U.S.C. 1857(h)), section 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and Environmental Protection Agency regulations (40 CRF part 15). L. 94-163, 89 Stat. 871). REPORTING REQUIREMENTS: Vendor is responsible for any and all reporting requirements associated with this RFP. Requirements may include but are not limited to: • FEMA and/or Federal reporting requirements as applicable. Deb Damore is the sole contact for this proposal. Actual contact with any other party or attempts by bidders to contact any other party could result in the rejection of their proposal. Documents - Bid Documents, General Documents and Description will be available at the pre-bid site visit or will be forwarded by mail. Modification & Withdrawal - Proposals may not be modified after they are received and recorded by the State of Vermont. Bidders may withdraw Bids at any time before bid opening, but will not be allowed to resubmit a bid. No proposal may be withdrawn or modified after bid opening except where the award of Contract has been delayed beyond 60 days. Project Timetable – The abatement work will start on or about July 28, 2014 and be completed within 20 working days. It is the Bidder’s responsibility to thoroughly read and comply with all instructions and requirements of this bid solicitation.
